Useful information about entry and obtaining a temporary residence permit in Kazakhstan

Hello everyone! My name is Dana and I work in the participant support office at Astana Hub. In this article, I want to share useful information about entering Kazakhstan and obtaining a temporary residence permit . If you are planning to temporarily settle in Kazakhstan, the information I will provide may be very useful for you.

 

Let's start with the rules for entering to Kazakhstan:

Document: International passport or national ID for citizens of EAEU countries.

Duration of stay: From January 27, 2023, citizens of the EAEU countries (Armenia, Belarus, Kyrgyzstan and Russia) may stay in Kazakhstan for no more than 90 days within 180 days from the date of crossing the border. Citizens of other states that can enter Kazakhstan without a visa may stay for no more than 30 days (exceptions: Iran, India, and China), but also a maximum of 90 days within 180 days.

Important exception: This rule does not apply to those who arrived in Kazakhstan with visa, as their legal stay period ends with the expiration of the visa. Also exempted are those who are in the country based on a temporary residence permit or a residence permit.

 

Next, you need to register (notification of arrival):

Foreign citizens arriving in Kazakhstan are required to register in the migration office within 3 working days from the date of arrival. This must be done to avoid problems at border control while leaving the country.

There are three ways to register:

  1. Through the visa-migration portal (vmp.gov.kz);
  2. Through the eQonaq portal (eqonaq.kz);
  3. Offline at the Migration Office: If it is not possible to register through online portals, it is necessary to personally visit the city's migration service and inform them about your stay, providing the necessary information and documents listed below.

Required documents for registration:

  • Passport copy: Please make sure that your passport is valid for the entire period of your stay in Kazakhstan (at least 3 months after the expiration of the registration period);
  • Intended place of residence in Kazakhstan;
  • The purpose of your stay in the country.

Do not forget to notify the migration service about each entry and exit from the country, as well as in case of changing the address of temporary residence in Kazakhstan.

 

About the process of obtaining a temporary residence permit:

Who needs to apply for a temporary residence permit?

  • Сitizens of CIS countries who have arrived in Kazakhstan for a period exceeding 30 calendar days.
  • Сitizens of the Eurasian Economic Union (Russia, Armenia, Belarus, Kyrgyzstan) and to citizens of other countries who have arrived in Kazakhstan for a period exceeding 90 calendar days.

Important to know: Obtaining a residence permit is a free of charge and usually takes only one business day.

 

How to apply for a temporary residence permit?

There are three methods allowed for submitting an application to obtain a temporary residence permit:

  1. In territorial police departments;
  2. In the public service center;
  3. Through the Electronic Government web portal for citizens (egov.kz).

Among the above-mentioned methods, the most convenient way to apply for a temporary residence permit  is through the web portal "Electronic Government for Citizens". Since using the other two methods it is necessary to submit an application at the place of registration of the recipient of services - a legal entity, as well as to have the original document certifying the identity of the foreigner. This process of obtaining a temporary residence permit can be complex and costly, especially if they are located in different regions of the country.

 

What documents are necessary for registration?

  1.  Application form for issuing a temporary residence permit;
  2. Copy of the document that confirms the identity of the foreigner or stateless person with whom agreements on visa-free stay are ratified (original provided for verification);
  3. Copy of medical insurance (original provided for verification): Except for citizens of the EAEU countries. They are not required to provide medical insurance.

Depending on the purpose of stay, additional documents will be required. In this case, we will only consider the requirements related to employment:

Notarized consent for the residence of an immigrant, in case the recipient of services is not the owner of the housing provided to the immigrant for temporary residence*; + + +

Permission to attract foreign labor issued by the local executive body; - + -
Certificate or permission issued by the local executive body of the Republic of Kazakhstan on the compliance of the foreigner's qualifications; - + -
Work permit for the immigrant issued by the local executive body, for carrying out labor activities for individuals; - + -

Certificate of state registration of a legal entity / registration of an individual entrepreneur; + + +
Notification of arrival; + + +

*While applying through the Electronic Government for Citizens web portal (egov.kz), it is not necessary to provide a notarized consent for the immigrant's residence. However, it is necessary for the property owner to sign the document using an electronic digital signature within 24 hours.

 

How to obtain a temporary residence permit for family members of an employee?

If one family member has obtained a temporary residence permit based on employment, then other family members have the right to obtain temporary residency permit . To do this, it is necessary to include the following family members together with the employee in the application.

Family members are allowed to obtain temporary residence permits for one year with the possibility of annual renewal, but the permit cannot exceed the term of the employment contract or civil contract for work (services).
