1. General provisions.

These Rules of Conduct on the territory of the Corporate Fund "International Technopark of IT Startups "Astana Hub" (hereinafter - the Rules) are developed in accordance with the Civil Code of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "On Informatization", the Rules of the International Technology Park "Astana Hub" (hereinafter-the Technopark), approved by the order of the Minister of Information and Communication No. 415 of the Republic of Kazakhstan dated September 26, 2018, by the Charter of the Corporate Fund "International Technopark of IT Startups "Astana Hub" (hereinafter - The Fund) and determine the uniform procedure for access to the Premises of the Fund, are designed to prevent and suppress illegal actions on the part of individuals and legal entities, the rules of conduct, the order and conditions of placement on the territory of the Fund in order to ensure and maintain effective functioning and reasonable use of areas (premises), common areas, to ensure the safety of interior items, and as well as ensuring security and public order on the territory of the Fund.

The Rules are designed to ensure compliance with the obligations of Users assigned to them by these Rules, as well as to create favorable working conditions and environmental protection on the territory of the Fund.

The requirements established by the Rules apply to all Users, and are mandatory for application and execution. Entry into the territory of the Fund implies acceptance by Users of these Rules, valid for the entire time they are on the territory of the Fund.

The general control over compliance with the Rules and maintenance of the established requirements is carried out by the Infrastructure Management Office.

The Fund has the right to take photos and videos of Users in order to prevent illegal activities on the territory of the Fund, including in the adjacent territory.

Violation of these Rules by Users is the basis for the Fund to consider the issue of denial of access to the User on the territory of the Fund, including grounds for termination of the contract and other agreements.

2. Terms and Definitions.

2.1. The following terms and definitions are used in these Rules:

2.1.1. Users - participants of the Technopark, participants of the Fund's programs, individuals and legal entities that have entered into an appropriate agreement with the Technopark / Fund, as well as legal entities that have entered into a memorandum, partnership agreement and other grounds (hereinafter referred to as certain categories of Users), employees of the above categories of persons who are with them in labor relations, or their executors who have entered into contracts of a civil law nature, persons permanently or temporarily working in the Fund, employees of the Fund, persons placed and staying on the territory of the Fund at the invitation or for other reasons, including citizens of the Republic of Kazakhstan and foreign citizens arriving on the territory Republic of Kazakhstan located on the territory of the Fund, including outside the contractual relationship.

2.1.2. Premises - a part of the space of a building or other real estate object, allocated for independent use, having a certain functional purpose and limited by building structures, as well as common space (corridors, halls, vestibules, shafts and other parts of the building) owned by the Fund, or owned by the Fund on the right of property lease.

 2.1.3. Agreement - an agreement between the Fund and individuals who are business entities or legal entities, the subject of which may be property rental (sublease), paid or free services, cooperation in the field of infocommunication technologies, supply of goods, works, services, provision of sponsorship or charitable assistance and other agreement, including memorandums, partnership agreements concluded between a separate category of Users and the Fund.

2.1.4. Technopark/Fund - Corporate Fund "International Technopark of IT Startups "Astana Hub".

2.1.5. Infrastructure Management Office (hereinafter referred to as the Office) is a structural unit that manages the infrastructure of the Fund, as well as general control over compliance with the requirements established by the Rules.

3. The mode of operation and the procedure for access to the territory of the Fund.

3.1. Operating mode:

3.1.1. Access for Users to the territory of the Fund is carried out around the clock, including weekends and holidays, in some cases, upon a pre-approved application with the Office (for unloading and loading cargo, etc.). The mode of operation on the territory of the Fund is regulated by the internal documents of the Fund.

3.1.2. In some cases, if there are objective grounds for this, changes may be made to the working hours, of which the Fund notifies Users by publishing on official accounts on social networks, instant messengers, on information panels, as well as on the official portal of the Fund.

3.2. Access to the territory of the Fund is carried out through:

3.2.1. ACS card or biometric data;

3.2.2. Applications from the structural divisions of the Fund, approved by the responsible person of the Office;

3.2.3. Pre-registration for a specific event;

3.3. The following are not allowed on the territory of the Fund:

3.3.1. Persons with substances and items prohibited from being brought into the territory of the Fund (Appendix 1 to the Rules), with the exception of employees of law enforcement and special bodies in the performance of their official duties.

3.3.2. Persons under the influence of alcohol, narcotic and toxic intoxication.

4. General rules and principles for the organization of work on the territory of the Fund.

4.1. Users are prohibited from making changes to the generally established design of premises. Cosmetic (current) repairs, painting of walls, replacement of ceilings, installation of additional heavy-duty or energy-intensive equipment, installation of additional partitions is allowed with the prior written consent of the Fund, subject to written submission of the project of changes to the premises.

4.2. Users are obliged to provide employees of the Fund and service organizations with unhindered access to any part of the Premises on the territory of the Fund to inspect the technical and sanitary condition and verify compliance with the Rules by Users, as well as to perform the necessary routine maintenance, repair and emergency work upon prior notification.

4.3. Users are obliged to maintain cleanliness in the Premises on the territory of the Fund.

4.4. Users are obliged to familiarize themselves with the evacuation schemes from the Premises before entering into the Contract.

4.5. In case of emergency circumstances (fire alarm, flooding, malfunction or failure of engineering systems, commission of a crime / offense, etc.), as well as in case of a potential threat to human life and health, Users have the right to immediate unhindered access to the Premises at any time in order to prevent or the elimination of such emergencies, as well as their consequences. ndati

4.6. Users are obliged to immediately inform the Fund's employees in any form about the facts that have become known to them.:

4.6.1. Emergency circumstances that entail or may entail a threat of harm to the life and health of people located on the territory of the Fund, damage to premises and property, including accidents and any illegal actions;

4.6.2. Malfunctions of engineering systems and equipment of the building located in the Premises and common areas.

4.6.3. Any damage and/or destruction of structures, elements of Premises, as well as any threat of their occurrence.

4.7. Users are prohibited from:

4.7.1. Storage of firearms, narcotic, toxic, radioactive substances, combustible and explosive mixtures, liquids, chemicals with a sharp and poisonous odor.

4.7.2. The use of a suspended ceiling structure for hanging any objects.

4.7.3. Enter the territory with any animals, aquatic and semi-aquatic mammals, insects, birds. The exception is guide dogs.

4.7.4. Use of bicycles and roller skates, scooters.

4.7.5. Install fastenings with curtains and install blinds, louvered openings, tinted coverings, films and protective screens on windows, glazed coverings without the written permission of the Fund, as well as restrict access or otherwise hinder access to heating pipes and sewer wells, ventilation and air conditioning hatches.

4.7.6. To interfere with the normal functioning of engineering communications (fire extinguishing systems, ventilation, heating, air conditioning, power supply, etc.) by using them for other purposes, turning them off and on independently.

4.7.7. Create any permanent or temporary barriers preventing free movement in public areas (entrances, exits, lobbies, corridors, elevators, escalators, staircases and platforms, foyers, etc.) not otherwise than on the basis of the written consent of the Fund.

4.7.8. To consume alcoholic beverages and narcotic substances, to be in a state of alcoholic, narcotic intoxication, under the influence of toxic and chemical substances on the territory of the Fund.

4.7.9. Make changes to the generally established design of common areas.

4.7.10. To carry out activities that do not correspond to the subject of contractual relations with the Fund (to set up trading tents, vending machines, trading equipment, conduct commercial promotions, etc.).

4.7.11. Exceed the number of workplaces stipulated by the terms of the Contract, as well as place personal or rented furniture and interior items.

4.7.12. Install remote devices and equipment (antennas, advertising illumination, advertising structures, radio transmitting devices, etc.).

4.7.13. Install electrical appliances without prior approval from the Fund.

4.7.14. To cause damage, inscriptions and images on the surface of walls, furniture and interior items installed in public areas, as well as on property legally transferred to the User for use.

4.7.15. To carry out photo or video shooting to mass media on the territory of the Fund, without the written consent of the Fund.

4.7.16. Use sound amplification means, listen to audio recordings, music without devices for personal listening to audio information on the territory of the Fund, in case of inconvenience to other Users.

4.7.17. Unauthorized movement of furniture and other items from designated places intended for public use.

4.7.18. Connection and use of household electrical appliances (electric stoves, etc.) in the Room for cooking without prior written approval from the Fund. It is allowed to connect electric kettles, microwave ovens in specially designated places.

4.7.19. To place and use equipment in the Room that produces an unacceptable level of noise, vibration, capable of causing significant inconvenience to other Users.

4.7.20. Offend persons located on the territory of the Fund and commit other actions discrediting honor, dignity or business reputation or aimed at inciting hatred or enmity, as well as humiliating the dignity of a person or group of persons on the grounds of gender, race, nationality, language, origin, attitude to religion.

4.7.21. Violate public morality and norms of behavior by exposing intimate parts of the body.

4.7.22. To enter places and areas not intended for public access, such as technical rooms, areas and places where access is restricted.

4.7.23. Distribute in any way products of a political, religious and racist nature (including posters, leaflets, booklets, etc.).

4.7.24. Park personal vehicles outside specially designated places (parking lots).

4.7.25. Smoking cigarettes on the territory of the Fund, including electronic cigarettes, tobacco heating systems and other similar devices.

4.6. In case of repeated violation of these Rules by the User, the Fund has the right to terminate contractual legal relations with the User.  Repeated is understood as violations of the rules of more than 2 (two) once a year.

5. The procedure for carrying out cosmetic and routine repairs in the premises.

5.1. Users may not, without the prior written consent of the Fund, carry out any kind of redevelopment, re-equipment and reconstruction of the Premises.

5.2. The control of the work is carried out by the responsible division of the Fund performing the function of managing the Fund's infrastructure - the Infrastructure Management Office.

5.3. When carrying out repairs, registration, redevelopment of Premises, installation of new technological equipment, it is necessary to comply with fire-fighting requirements, norms of construction and technological design, passages to evacuation routes must be provided in accordance with the norms of the current legislation of the Republic of Kazakhstan.

5.4. Users ensure the safety and integrity of the Fund's property during the delivery of goods and work on the territory of the Fund, as well as compliance with these Rules.

5.5. Carrying out work at night, as well as on weekends, is allowed by prior written agreement with the Fund (during the working day from 09.00 to 18.30 hours) at least 1 (one) working day before the start of the work, indicating all of the above information, including the list of employees.

5.6. Upon completion of the work, the representative of the Fund accepts the completed works, as well as the premises in which the work was carried out by contractors. In case of detection of defects in the condition of systems or other property in the building, a corresponding defect report is drawn up and the procedure for eliminating defects is determined.

5.7. Cleaning of the premises after carrying out repair, economic and other works is carried out by the forces and means of the User or the contractor who performed the work.

6. Procedure for the use of public spaces.

6.1. Under these Rules, common areas are understood as recreation areas in Coworkings, landings, stairs, halls, elevators, elevator and other shafts, corridors, kitchens, parking, passages and corridors in the Premises, escalators, fire escapes, toilets, loading platforms, transport and pedestrian entrances and approaches to the adjacent territory, places for installation and maintenance of equipment, places for collection and disposal of waste, etc.

6.2. Users are obliged to take care of the structures, elements of the Premises, property, interior items, plumbing, electrical appliances, communications and fire alarms, utilities, etc., and not obstruct the use of common areas by other persons.

Final provisions.

8.1. These Rules, as well as any amendments and/or additions to it, come into force from the date of approval by the General Director, or a person acting in his capacity, and are valid until he makes a decision to terminate the Rules.

8.2. In case of disagreement between individual clauses of the Rules and the current legislation of the Republic of Kazakhstan, such clauses become invalid, and in terms of requirements, conditions and other circumstances regulated by these clauses, one should be guided by the norms of the current legislation of the Republic of Kazakhstan until the relevant changes are made to these Rules.

8.3. Issues not regulated by these Rules are governed by the current legislation of the Republic of Kazakhstan, the Fund's internal regulatory documents and / or decisions of the General Director, or the person acting as such.

List of substances and items prohibited from being brought into the territory of the Fund

Firearms, traumatic, edged weapons;

Explosives, explosive devices, including flares, firecrackers, gas and paint cans, and flammables, except for matches and pocket lighters;

Potent toxic substances;

Narcotic, psychotropic, chemical, toxic substances;

Alcoholic drinks of any kind;

Technical means, special technical devices (listening devices, devices designed for surveillance) that can interfere with the operation of equipment (laser devices, lights) of the radio station;

Large items that create inconvenience to other Users, as well as high-speed vehicles (bicycle, scooter, skateboard, gyro scooter, segway, roller skates), except when the carrying of such items is agreed with the Fund;

Propaganda materials of a pronounced extremist nature or containing Nazi attributes or symbols or attributes or symbols of extremist organizations.
